Unplanned or unwanted pregnancy, what can we do?

When an unintended pregnancy occurs, we have the right to decide whether we want to continue with it or want to terminate it (Voluntary Termination of Pregnancy). Below we tell you what the Law says about it in the context of Spain in 2023:
According to Organic Law 1/2023, of February 28, which modifies Organic Law 2/2010, of March 3, of sexual and reproductive health and voluntary termination of pregnancy:

  • Pregnancy can be terminated up to the 14th week of gestation.
  • From week 14, it can be interrupted only for medical reasons until week 22: serious risk to health or life or serious anomalies in the fetus.
  • It is a confidential process, the decision to terminate the pregnancy does not have to be justified.
  • People 16 years of age or older do not need external consent to perform an IVE .
  • People under 16 years of age or whose legal capacity resides with another person, need the consent of their mother, father or legal guardian.
  • This is a free intervention for those who receive it, since it is covered by Social Security.
